Sorry to hijack your thread but I didnt want to start multiple threads on the same issue, along similar lines where can I find the actual law on H1B portability on I 140.
I have a offer but the immigration dept of the company says it cannot be done so I need to send them some documentation.

I checked with attorney and I believe that is true, PP for H1b is not carried over on RFE reply. Response to RFE will go in a regular queue for evaluation. But, I hope this is not the case.
Yes, I read in forums RFE's and 221g both have become more regular these days.

Hi,
I applied for H1 last year and got H1 approved for 9 months. (they counted all my stay on H4). Now H1 expired on 25th Nov and applied for H4 on 15th Nov before H1B expires.
I wants to take advantage of New memo of USCIS. Can I apply for H1B with different employer than earlier one while my H4 case is pending?
Or shall I wait until I gets H4 approval and they apply for H1B.
Please help me on this.

I had a similar question -- how does processing dates work ? for eg - texas processing dates shows -- the date to be june/2007.
say for EB3 the visa date is nov 2001 and if a person X with a pd of mar/2003 applies for his 485 on july 2007 ...will his case be processed ??
(In other words - will they even touch his file or will they wait for the visa dates to become current before touching the file ??)

Why do you think that will happen..
I am guessing that if you 140 is approved (which is company based), then you are good because 485 is based entirely on the applicant..

Do you know what is a common practice of USCIS in case they don't find our reply to such RFE good enough? Do they follow up with another RFE or just deny I140? I'm trying to figure out how much time will I have to pack my stuff if things go really bad :).

When these informations are now available, there is no use/need for a poll of this kind. It boils down to why take sample data when you have complete data provided by USCIS and DOS.

I guess EAD is personal property not employer property. I had filled my I-485, EAD and AP and my employer does not even know it. On top of it i had completed 180 days and moving to another job.
Are you in H1B or EAD. If in EAD you have to renew it yourself the employer has nothing on your EAD.
I am seeing lots of people change their jobs once 180 days expire...Just trying to get an idea whether people mostly use H1 transfer or do they start using EAD? Does changing a job while 485 is in progress always triggers an RFE/interview?

Rep. Steve King (R-Iowa) isn�t wasting any time with his immigration agenda, dropping a bill on the first day of Congress that goes after birthright citizenship.
King�s measure would amend the Immigration and Nationality Act, ending automatic citizenship for anyone born in the country. Instead, the measure requires that only the children of citizens, legal immigrants permanently living in the country or immigrants in the military, be granted citizenship.
Republicans grabbed headlines last summer after Sen. Lindsey Graham (R-S.C.) criticized the longstanding law, saying it encourages pregnant women to come to the country to have children so they can eventually become citizens themselves.
Though others have called for changing the 14th Amendment, King said that ending birthright citizenship through statute makes sense because it�s easier to do.
�We need to address anchor babies,� he told POLITICO Wednesday. �This isn�t what our founding fathers intended.�
Immigration legislation isn�t high on the list of priorities for House GOP leaders.
