Anyone who has succefully self filed for an Advanced Parole who can help me on this question?
What is the answer you put to answer the question:
"On a seperate sheet of papaer, please explain how you qualify for an advance parole and what circumstansces warrant issuance of advance parole. include copies of any documents you wish considered. "

I entered exactly the following on a separate sheet for that item:
"Pending adjustment of status petition. Lengthy adjustment and the need to visit family from time to time."

I self filed for I-131 (both for my spouse and myself) and had no problem with the approval.

My relative tried to get visit visa from Kuwait. He was there on visit. Embasssy rejected the petition and told him to go India and get the visa. Eventually he got it in Madras. Only residents can appear for visa interview. (residents means, locals or, those have employment or dependant visa and stamped residence in passport).

If they are staying on a resident or employment visa in UAE they have to apply at the US Embassy in Dubai. If they are on a visit visa in UAE, they have to apply at the appropriate US Consulate in India.

I tried it. They might wont ask new approval notice. You should show that and get the expiry date in I-94 as same as your latest I-797 Approval notice.

You don't need to stamp visa as its not expired.....

Helllo Experts,

Here is my Case:

Have 4 yrs of work experience and changed 3 employers in the past.

1 st employer: Worked as a Programmer Analyst for 6 months
2nd employer: Worked as Sr.Software Engineer for1.6 years
3rd Employer: Worked as Sr.Software Engineer for 2 years

Under unexpected circumstances, 2nd employer filed my H1 for a senior level even when I have only 2.5 yrs of experience.

I am trying to change job and look for a prospective employer who would file my labor/GC immediately.

The 4rth employer is willing to my GC but the Job designation will be Software Engineer.

Can you please advise if there would be any negative impact on my GC process if I take a step down in my title.

I liked the organization, work environment and all I am concerned now is about any RFC's for the different Job Titles I had so far.

I am in a very confused state and Please advise me as I need to respond for the Job offer.

I sincerely appreciate your help.

I always belive Premium is better and this is just a rumour that it attracts RFE.

The reason is plain and simple, let's say that you change to Company B and since normal processing takes anywhere from 3-6 months (let's say in meantime your old employer cancells your H1B) and at end of say 3-6 months you come to know that your H1B transfer to company B is denied you have no option but to leave country.

Whereas in permium in 15 days you will know if that is through or not and GOD forbidden even if that gets rejected , you still have paystubs which will be just 15 days old, still you can do another H1B transfer with a new employer.

Its been more than a month that my employer got the approval email but the lawyers say they never got the paper cert. In their opinion, now it is too late to expect the paper. They also say that it is impossible to get a duplicate cert from DOL.

The only option, per my lawyers, is to file a regular I140 and ask USCIS to get the duplicate directly from USDOL when we get the RFE.


Has anyone else had a similar experience or is the laywer pulling my chain since i have three EADs and APs due for approval in 3 months.

Can folks confirm that PERM certs indeed go missing and this is the only recourse?

Yeah. Mention the company's name that filed GC for you/wife. I did the same for my wife. During the interview we both were asked about whether employer had filed for our GC and we said yes. We got the visa, no issues whatsoever.

You can still get a 1 year extension claiming that your PERM application is still pending. It all depends on the officer that the decision has not been made on PERM application.

How he can claim that "PERM application is still pending" when it's already denied!!! :)

I am currently unemployed and my spouse needs to travel to Mumbai urgently. Our AP is valid through November 30, 2009. Will there be any issues for my wife when she comes back - possibly because of my current status. Wife is employed (with a different company)& the EAD/AP was filed by my last employer. I think Ubaidu's problem is that his degrees are in a different field of study from that of his job. For EB2 the USCIS will surely look into the relevance of the Masters degree to the job description.
