KXAN reporter Matt Flener requested the following:

Im looking to do a story on immigrants that get bad immigration lawyers. You know, the ones that say theyll do it for really cheap, yet screw everything up. Do you know what Im talking about?

Also, do you know of any other stories through your affiliation with immigration voice that I could work on? Any place where people trying to get into this country legally are not getting a fair chance.

    Sincerely,
    Matt Flener
    Reporter
    KXAN Austin News

Do we have any one here in Texas (Austin would be better as he can come by and talk to you) whose lawyer experiences are a nightmare? Let me know and I can put you in touch with Matt Flener.

    hi there.
I need to talk to an immigration lawyer.
Can you refer me an Immigration lawyer in San Jose/Bayarea?
Also how much does he/she charge per hour?

I read about the free immigration question/answer through IV. Is there anything for Nov? Thanks.

    Hi,

Can someone please tell me the entire process involved to bring parents to U.S as Visitors.I know few things but am very confused about the documents we need to send and needed application forms .

I went through vfs site for required documentation (I know we should book the interview date through vfs-usa site.)

They mentioned DS-156 and I-134 forms. where to get these forms from?
What are the documents that should be sent from U.S
What about the financial support proof. Should we show specific amount as proof of support for each person visiting?

    Please Advise.
    Thank you.

For the DS-156 and I-134 forms you can download it from travel.state.gov.

List of reqd docs from US:

    Couple months of your paytubs
    Last 2 years of W2.
    Full Passport copy.
    Employment letter.
Bank statements showing the balance (from the date account is opened).
your status in US( say I 797 approval notice and I 94)

    Guys ,
I just checked my I140 approval notice and it shows LUD as July 28th 2007

I am totally confused as to why it shows that since my I140 is approved since a long time .

I have applied for 485 on June 29th 2007 and it reached USCIS TSC on July 2nd 2007.

Does the LUD on my I140 have anything to do with my 485 Application ??

    Please advise ?

AILA Leadership Has Just Posted the Following:

In Get In The Line? What Line? The Tragic Tale of Employment Based Immigrant Visa Delays (http://ailaleadership.blogspot.com/2009/10/get-in-line-what-line-tragic-tale-of.html), I stated that:
This delay in legal, employment based immigration is a crisis for America. If you are an intending immigrant, and your immigration option is employment based, do you have the patience the wait 15 years for your green card? Can you do better in Australia, Canada, or even back home in our home country? What is the cost to our future competitiveness of a broken legal immigration system? What is the cost to U.S. innovation? The Department of State just released its annual numbers for cases received by the National Visa Center, awaiting issuance of an immigrant visa at a consulate. The report says this:
The following figures have been compiled from the NVC report submitted to the Department on November 3, 2009, and show the number of immigrant visa applicants on the waiting list in the various preferences and subcategories subject to numerical limit. All figures reflect persons registered under each respective numerical limitation, i.e., the totals represent not only principal applicants or petition beneficiaries, but their spouses and children entitled to derivative status under INA 203(d) as well. Okay, the bottom line numbers? Bad, very bad. The total Family Numbers waiting for a priority date: 3,369,455, including 1,727,897 in the Brother and Sister (FB-4) category. At the 65,000 annual number level for that category, that is a 26.5 year wait (ignoring per country limits). The total Employment Numbers awaiting a priority date: 130,509, including 119,759 in the EB-3 category. This is at least a 3-4 year wait (again, ignoring per country limits). So, 3.5 million people waiting in line, or is it? The reality is worse. These do NOT include the those cases pending at USCIS!

If we ad in the numbers pending at USCIS (as best we know them), the situation is far more grave. Family based petitions pending at USCIS in June 2009 (no new numbers are easily available), were 1.1 million, bring the total backlog to 4,400,000 for family cases. Employment based cases pending at USCIS in June 2009 numbered 80,000. This bring the total up to 210,000 for EB-3 cases. Wow!

It gets worse though when you realize this simple fact. The numbers from the National Visa Center do not include cases for folks NOT consular processing. Frankly, and just just like in October when I first wrote about this, we do not really know exactly how many cases are pending immigrant visa availability. What we do know is that the legal immigration system is broken.

When we hear politicians and uninformed folks yelling about illegal immigration and telling folks to wait in line like everyone else, the answer is, What Line?

These numbers once again poignantly express the dilemma that legal immigrants have. Many feel, justifiably, that any immigration reform must FIRST focus on legal immigration reform, cutting down wait times to reasonable periods, BEFORE anyone who entered into or remained in the U.S. without permission is given ANY legal benefits. The answers are simple here, the question is, are there any politicians with enough courage to vote for real legal immigration reform?https://blogger.googleusercontent.com/tracker/186823568153827945-373880418577926333?l=ailaleadership.blogspot.com

Yedy - I would appreciate that you let a healthy discussion take place on these forums rather than posting wrong information and shunning out people. The community is here to help and there may be many in similar situations. I am talking to a lawyer even before you preached it. This is a forum to get second opinions and real life examples. I am sure no one here (including you) takes the advice from these forums literally and implements it

Also wanted to mention that your I-20 will have information on when the OPT was applied (at least that's how it was in my case). I got a new I-20 when I applied for OPT (indicating that it was pending), and then another one when it was approved.

Another point - they generally approve the OPT and issue the EAD within three months. So now you have the month narrowed down to 3 (from the month of your approval).

    dealsnet

OP says 'My Green Card gets approved today, while my wife and son's stays pending.'
His GC approved. Waiting for card. Do you read some thing else?
If he want to ask hypothetical question, he is a stupid to start a thread.

I thought the OP was making a case for getting his question answered.. that doesn't mean the case is necessarily true now.

And I think if you read further down, the op himself said he didn't get his GC yet, but his question was "what if?"...... guys read before you post ;)

    Hi,

My name is Rajeev. Im working as a senior technology consultant (Senior Business Analyst and Senior Quality Assurance) with a top IT consulting and service company.

    Background:

My H1-B visa and 1-94 are expiring on July 06th 2009 (almost 4 months from now) and final 6 year H1-B time is ending on May 2011.

I spoke with the HR manager of my company to renew my H1-B visa four times in last couple of months but every time she says that there is of integration going on (Actually, my company was acquired by another company and right now integration is going process is going on). However, I spoke with the immigration department of my company and they told me that since integration process is under way, however this integration process will not effect the renewal of H1-B process, company will deal it in the same way it was dealing before. I explained this thing to my Manager on Tuesday but again, she was not convinced and want to speak with the her immigration contacts and advised me to wait and didnt gave me a date when she is going to get back to me ( I dont know what is going on in her mind).

So far, Ive not applied for Green card, actually, last September, I submitted all the paper work to my Manager (till Dec 2008, I was employed with the consulting division of my company and afterward, I was transferred to the local account). With this transfer, my consulting division manager refused to process and pay for my GC and advised me that I should apply it through local account.

Now local account is saying that it is very unlikely that theyll sponsor my GC because there is lot of cost cutting going on and GC process takes anywhere from 10 K to 14K. I did told them that company may deduct the GC fees through my pay. But I didnt hear anything from them so far. Its been almost 2 months now.

    Advise and Help:

Since my final H1-B is expiring on May 2011. Almost 2 years and 2 months. My GC is not filed yet. What should I do now?

    1. Look for a new job, who can sponsor my H1-B (actually, Ive started looking but no luck yet).
    2. What if if I dont find a job till July 6 2009?
    3. is it a good idea to transfer my H1-B visa to Indian consultancy company without a project in hand?
    4. Please recommend good Indian consultancy companies to whom I speak regarding my H1-B transfer and GC application process.

Please ask me specific questions or which I may not have addressed above or Ive not explained any section above.

On the different note, I was also got stuck in Canada last year from April 2008 to Aug 2008. Here is my previous post http://immigrationvoice.org/forum/showthread.php?p=279088.

    Many thanks!

    Rajeev
